These terms explain the rules for using Fortelk websites, demos, application services, AI employee workflows, messaging, calling, and CRM-related services.

These Terms of Use govern access to and use of Fortelk websites, applications, demos, AI employee workflows, messaging, calling, and CRM-related services. By using Fortelk, creating an account, connecting a channel, submitting a form, requesting a demo, or using the service under an order form, you accept these terms.
If you use Fortelk on behalf of a company or other organization, you represent that you have authority to bind that organization to these terms.
Fortelk Inc. provides an AI workforce platform for repetitive revenue conversations. Customers use Fortelk to configure AI employees for outbound outreach, inbound intake, follow-up, customer reactivation, inbox triage, voice calls, SMS, WhatsApp, email, CRM updates, summaries, routing, and human handoff.
Fortelk may provide websites, forms, demos, workflow mapping, AI call request flows, messaging integrations, CRM integrations, calendar integrations, background workflow execution, analytics, and related support services.
You must provide accurate account, company, billing, and contact information. You are responsible for maintaining the security of your login credentials, connected accounts, API keys, tokens, phone numbers, WhatsApp Business Accounts, CRM accounts, calendars, email accounts, and other systems connected to Fortelk.
You must promptly notify Fortelk if you believe your account or a connected system has been compromised.
You may not use Fortelk for illegal activity, spam, harassment, deception, impersonation, unauthorized scraping, malware, unlawful surveillance, discriminatory activity, or contacting people without a lawful basis.
You are responsible for complying with laws and rules that apply to your communications, including TCPA, CASL, GDPR, privacy laws, consumer protection laws, telemarketing rules, carrier rules, email rules, and local telecom requirements.
You may not use Fortelk to send messages or make calls that violate WhatsApp Business Messaging Policy, Meta policies, Twilio policies, email provider policies, carrier rules, or the terms of any connected platform.
You are responsible for the consent, lawfulness, accuracy, and source of the leads, contacts, customer lists, phone numbers, email addresses, WhatsApp contacts, CRM records, and databases you provide to Fortelk.
You are responsible for approving scripts, templates, offers, claims, handoff rules, disallowed topics, compliance instructions, and workflow boundaries before using AI employees in production.
When using WhatsApp through Fortelk, you must comply with the WhatsApp Business Messaging Policy, obtain required permissions, use approved templates where required, respect the 24-hour customer service window, and honor opt-out or stop-contact requests.
You must disclose AI usage to end leads, prospects, customers, or other contacts where required by law or platform policy.
Fortelk owns the Fortelk platform, software, workflows, templates, interface, documentation, website, design, service configuration, and related intellectual property, except for customer data and third-party materials.
You retain rights to your customer data, lead data, CRM data, contact lists, conversation history, and content you provide to Fortelk. You grant Fortelk the rights needed to host, process, transmit, analyze, transform, summarize, and use that data to provide the service.
Each party may receive non-public business, technical, operational, pricing, customer, workflow, or integration information from the other party. The receiving party must use reasonable care to protect confidential information and use it only to provide or receive the service.
Confidentiality obligations do not apply to information that is public, already known without restriction, independently developed, or lawfully received from another source.
Fortelk uses artificial intelligence to generate, route, summarize, classify, and assist with voice calls, text replies, WhatsApp messages, SMS, emails, CRM updates, and follow-up actions on a customer's behalf.
AI outputs can be inaccurate, incomplete, delayed, or inappropriate for a specific context. Customers must review, approve, and supervise scripts, templates, workflows, handoff rules, and sensitive use cases.
Customers should disclose AI usage to end leads, prospects, customers, employees, or other contacts where required by local law, industry rules, or platform policy.
Fees, usage limits, included services, payment timing, and subscription or deployment terms are set out in the applicable order form, proposal, statement of work, invoice, or written agreement.
Unless a written agreement states otherwise, usage-based costs such as calling, SMS, WhatsApp, email, AI inference, voice generation, data enrichment, and integration costs may be charged separately or used to determine the scope of a deployment.
These terms apply while you access or use Fortelk. Either party may terminate access according to the applicable order form or written agreement.
Fortelk may suspend or terminate access if you violate these terms, fail to pay amounts due, create security risk, create legal or platform-policy risk, or use the service in a way that could harm Fortelk, another customer, service providers, communication networks, or end users.
After termination, Fortelk may retain data as described in the Privacy Policy, applicable law, backup practices, and any written agreement.
Fortelk is provided on an as-is and as-available basis except as expressly stated in a written agreement.
Fortelk does not guarantee lead conversion, revenue outcomes, appointment attendance, CRM accuracy, message deliverability, call answer rates, AI output quality, or uninterrupted service.
Fortelk does not provide legal, medical, mortgage, financial, tax, real estate brokerage, or other regulated professional advice. AI employees support repetitive workflows, routing, summaries, scheduling, and follow-up. Human professionals remain responsible for judgment, advice, offers, compliance, and final decisions.
To the maximum extent permitted by law, Fortelk is not liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, business opportunity, or revenue.
To the maximum extent permitted by law, Fortelk's total liability for claims arising from or relating to the service is limited to the fees paid by the customer to Fortelk for the service giving rise to the claim during the 12 months before the event giving rise to liability.
You will defend, indemnify, and hold harmless Fortelk Inc. and its officers, directors, employees, contractors, service providers, and affiliates from claims, damages, liabilities, penalties, fines, costs, and expenses arising from your data, lead lists, consent practices, connected accounts, scripts, offers, instructions, misuse of the service, violation of law, violation of platform rules, or breach of these terms.
These terms are governed by the laws of Ontario, Canada and the applicable federal laws of Canada, without regard to conflict of law principles.
The courts located in Ontario, Canada will have jurisdiction over disputes arising from these terms unless a written agreement states otherwise.
Fortelk may update these terms when the service, legal requirements, platform rules, or business practices change. Updated terms will be posted on this page with a new effective date. Material changes may also be communicated by email or in-product notice when appropriate.
